Actions of the vetting authorities after Decision of the Constitutional Court determining Section 5 of Article 40, Paragraph 1 of CIPA against the Constitution

Taking into account the Decision of the Constitutional Court in force by which Section 5 of Article 40, Paragraph 1 of CIPA has been determined as provision against the Constitution the vetting authorities have to continue with all the checks performed up to now as per CIPA including for preliminary legal proceedings or legal proceedings against the vetted person.

In case there are data of such, the latter cannot be used as grounds for denial or withdrawal of access to classified information but have to be discussed with a view to the reliability of the person regarding to the security and safeguarding of the secret.
