Industrial Security

Industrial security is a system of principles and measures which are implemented with regard to candidates – individuals and legal entities – during the concluding or fulfillment of a contract involving access to classified information with the purpose of its protection from unauthorized access (Article 95, Paragraph 1 from CIPA).

The procedure is initiated in two ways: by a Contracting Authority or after registration in the database of the Ministry of Economy for participation in NATO procurements.

With regard to the preparation and the execution of the public procurement with regard to access to classified information, the initiation of the vetting procedure for reliability is done by the Contracting Authority. Apart from the required documents for the vetting procedure of the employees of the candidate for the public procurement, the Contracting Authority is obliged to enclose the following documents:

• request for facility security clearance of the legal entity;
• request for NATO security clearance certificate – if necessary;
• request for EU security clearance certificate – if necessary;
• questionnaire in accordance with Article 98 of the Classified Information Protection Act (CIPA) – Appendix 23 to Article 173, Paragraph 1 of the Regulation on the Implementation of the Classified Information Protection Act (RICIPA);
• consent for vetting procedure in accordance with Article 97 of CIPA by the persons who manage and represent the candidate applying for contractor – Appendix No. 22 to Article 171, Section 2 of the RICIPA;
• declaration in accordance with Article 74, Paragraph 2, Section 1 of the Tax-Insurance Procedure Code, on industrial security;
• consent on the grounds of Article 43, Paragraph 2 of the CIPA, with regard to Article 62, Paragraph 9 of the Credit Institutions Act , on industrial security.

The requests for issuing certificates are signed and submitted only by the Contracting Authority.

When initiating the procedure on the grounds of the registration in the public database of the candidates for participation in NATO international procedures of the Ministry of Economy apart from the required documents for the personnel security procedure and the abovementioned industrial security documents, the legal entity submits to SCIS:

• motivation letter by the legal entity-candidate (free text), justifying the need for access to NATO classified information;
• copy of a letter of the Ministry of Economy certifying the presence of registration for the current year in the public database of the candidates for participation in NATO international procedures;
• requests for issuing NATO security clearance certificates to the legal entity, the Head of Organizational Entity, the Information Security Officer, the Head of the Registry and the Deputy Head of the Registry (in accordance with the abovementioned forms).

 

This procedure requires also the opening of national registry for classified information at the appropriate level.
