Organized Round table on: “Cases before the European Court of Human Rights where classified documents containing national classified information have to be provided”

On 22 February 2012 at 10 o’clock in the Training center of the State Commission on Information Security (SCIS) in the town of Bankya round table on: “Cases before the European Court of Human Rights where classified documents containing national classified information have to be provided” was held.

Judges from the Supreme Court of Administration, representatives of the Ministry of Justice, of the Ministry of Interior, of State Agency for National Security (SANS) and of SCIS participated during the round table. 

SCIS presented the European practice with regard to providing national classified information to national courts and to the European Court of Human Rights.
 
Issues in relation with providing Bulgarian classified information to the European Court of Human Rights in the hypothesis of appealing of decisions of Bulgarian court as well as to compulsory administrative measures stipulated by the Chairperson of SANS and their appealing in accordance with the legal order. Review of the judicial practice on this subject was made.
 
In context of the reviewed issues the round table was beneficial in a view to finding a balance between the constitutional right for protection of the parties in a court case and the right for publicity of the judicial acts and the protection of information related to national security.
